- There is much confusion among employers about how to properly give severance to employees who are 40 years of age or older.
AGE DISCRIMINATION AND EMPLOYMENT ACT (ADEA): Employers with 20 or more employees are covered by the Federal law, the Age Discrimination and Employment Act of 1967 (ADEA). The ADEA prohibits age discrimination against employees 40 years of age or older.
